Terms of Service & End User License Agreement
1. Acceptance of Terms
By accessing or using PumpForge ("the Platform"), operated by PumpForge LLC ("Company," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by this Agreement, including the End User License Agreement provisions in Section 9. If you are accepting on behalf of a fire department, municipality, fire district, or other organization ("Organization"), you represent and warrant that you have the legal authority to bind that Organization to this Agreement. If you do not agree, do not access or use the Platform.
2. Description of Service
PumpForge is a web-based, software-as-a-service (SaaS) pump operator training platform designed for fire departments. The Platform provides simulated pump panel environments, scenario-based training exercises, automatic scoring, certification tracking, real-time simulation monitoring, and related training management tools.
Training Supplement Only. PumpForge is a training supplement and does not replace hands-on training, live evolutions, or compliance obligations under NFPA 1002 or any other applicable standard, regulation, or law. Departments are solely responsible for ensuring their personnel meet all applicable NFPA, state, and local certification requirements.
3. Accounts and Registration
You must provide accurate and complete information when creating an account. The department administrator who registers is responsible for managing user accounts within their Organization. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@pump-forge.com if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that contain false or misleading registration information, or that are used in violation of this Agreement.
4. Subscription Plans and Payment
PumpForge offers subscription plans as described on our Pricing page. All fees are billed in advance on a monthly or annual basis. Payments are processed through Stripe, Inc. ("Stripe"). You authorize us to charge your designated payment method for all fees incurred under your subscription. Prices are subject to change with 30 days' written notice to the department administrator of record. Failure to pay may result in suspension or termination of access.
All fees are non-refundable except as expressly stated in this Agreement or as required by applicable law. Disputed charges must be reported within 60 days of the billing date.
5. Free Trial
New departments may receive a limited free trial on the Demo plan. At the end of the trial period, access to training features will be restricted until a paid plan is selected. No payment information is required to start a trial. We reserve the right to modify or discontinue the free trial at any time without notice.
6. Acceptable Use
You agree not to:
- Share login credentials with unauthorized individuals or allow access by anyone not covered by your subscription
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code, algorithms, data structures, or underlying ideas of the Platform or any component thereof
- Copy, reproduce, modify, adapt, translate, or create derivative works based on the Platform, its software, content, or documentation
- Use the Platform to store or transmit malicious code, viruses, or any harmful software
- Interfere with or disrupt the integrity, performance, or security of the Platform or its infrastructure
- Access accounts, data, systems, or networks you are not authorized to access
- Resell, sublicense, lease, lend, or redistribute access to the Platform without prior written consent from PumpForge LLC
- Use automated tools, bots, scrapers, crawlers, or any other automated means to access, scrape, extract, download, index, or collect data from the Platform
- Use the Platform for competitive analysis, benchmarking, or to build a competing product or service
- Remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed on or within the Platform
- Circumvent, disable, or interfere with any security, authentication, or access control features of the Platform
- Use the Platform in any manner that violates applicable federal, state, or local law or regulation
7. Data Scraping and Automated Access Prohibition
You expressly agree that you will not, and will not permit any third party to, use any robot, spider, scraper, crawler, data mining tool, or any other automated means to access, collect, copy, or extract any data, content, or information from the Platform. This prohibition applies to all Platform content including but not limited to: simulation parameters, hydraulics calculations, scenario configurations, training content, NFA evolution data, user interface designs, and any other proprietary data or content.
Any unauthorized automated access constitutes a violation of this Agreement and may constitute a violation of the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and applicable state computer crime laws. We reserve the right to take technical measures to prevent automated access and to pursue all available legal remedies against violators.
8. Training Disclaimer
PumpForge is a training tool, not a certification authority. Simulation results, scores, and certifications generated by the Platform are intended to supplement — not replace — hands-on training, live pump operations, and evaluations conducted by qualified instructors. Departments are solely responsible for ensuring their personnel meet all applicable NFPA, state, and local certification requirements. We make no guarantee that use of the Platform satisfies any regulatory or compliance obligation.
9. Intellectual Property and End User License Agreement (EULA)
9.1 Ownership. The Platform, including all software, source code, object code, algorithms, data structures, hydraulics models, simulation engines, user interface designs, graphics, templates, stylesheets, audio files, training content, NFA evolution scenarios, documentation, and all other materials (collectively, "Platform IP") are and shall remain the sole and exclusive property of PumpForge LLC. The Platform IP is protected by United States and international copyright, trademark, trade secret, patent, and other intellectual property laws.
9.2 License Grant. Subject to your compliance with this Agreement and payment of all applicable fees, PumpForge LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform solely for your Organization's internal fire department training purposes during the term of your subscription. This license does not include any right to:
- Access, view, or obtain the source code of the Platform
- Modify, adapt, translate, or create derivative works of the Platform or any component thereof
- Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or data structures of the Platform
- Copy, reproduce, or duplicate the Platform or any portion thereof
- Sublicense, lease, rent, loan, sell, or distribute the Platform or access thereto
- Use the Platform to develop, train, or improve any competing product or service
- Remove or alter any proprietary notices, labels, or marks on the Platform
9.3 Trade Secrets. You acknowledge that the Platform contains valuable trade secrets of PumpForge LLC, including but not limited to: the hydraulics simulation engine and its algorithms, the real-time physics runtime architecture, the scoring and grading methodologies, the database schema and data models, the simulation panel rendering system, and the integrated sales and business management tools. You agree to maintain the confidentiality of all such trade secrets and to not disclose, publish, or disseminate any information regarding the internal workings, algorithms, or architecture of the Platform to any third party.
9.4 Trademarks. "PumpForge," the PumpForge logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PumpForge LLC. You may not use such marks without the prior written permission of PumpForge LLC. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.
9.5 Feedback. If you provide any suggestions, ideas, enhancement requests, feedback, or recommendations regarding the Platform ("Feedback"), you hereby assign to PumpForge LLC all right, title, and interest in and to such Feedback. PumpForge LLC shall be free to use, incorporate, and commercialize any Feedback without restriction, attribution, or compensation to you.
9.6 Reservation of Rights. All rights not expressly granted in this Agreement are reserved by PumpForge LLC. No implied licenses are granted by this Agreement.
10. Data Ownership and Privacy
10.1 Your Data. Your Organization retains ownership of all training data, user information, and records entered into or generated by the Platform ("Customer Data"). We will not sell or share your Customer Data with third parties for their marketing purposes.
10.2 License to Customer Data. You grant PumpForge LLC a limited, non-exclusive license to use, process, and store Customer Data solely for the purpose of providing, maintaining, and improving the Platform. We may use anonymized, aggregated data that does not identify any individual or Organization for analytics, benchmarking, and product improvement purposes.
10.3 Privacy. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference.
11. Data Export and Portability
You may export your Organization's training records, certification data, and user information at any time through the Platform's export tools. Upon account termination, we will retain your Customer Data for 90 days to allow for export, after which it will be permanently deleted unless otherwise required by law or unless you request earlier deletion in writing.
12. Confidentiality
Each party agrees to maintain the confidentiality of any non-public information disclosed by the other party in connection with this Agreement ("Confidential Information"). Confidential Information includes, without limitation, the Platform's technical architecture, pricing terms, business plans, and Customer Data. Neither party shall disclose Confidential Information to any third party without the prior written consent of the disclosing party, except as required by law or court order.
13. Warranty Disclaimer
14. Limitation of Liability
14.3 Essential Basis. The limitations of liability in this Section 14 are an essential element of the basis of the bargain between you and PumpForge LLC. PumpForge LLC would not provide the Platform without these limitations.
14.4 Applicability. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of PumpForge LLC shall be limited to the greatest extent permitted by applicable law.
15. Indemnification
You agree to indemnify, defend, and hold harmless PumpForge LLC, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising from or related to: (a) your use of the Platform; (b) your violation of this Agreement; (c) your violation of any applicable law or regulation; (d) your infringement of any third-party intellectual property or other rights; or (e) any content or data you submit to or through the Platform.
16. IP Infringement Reporting
If you believe that any content on the Platform infringes your intellectual property rights, please notify us at legal@pump-forge.com with: (a) a description of the copyrighted work or other IP you claim has been infringed; (b) identification of the material you claim is infringing; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the IP owner or authorized to act on the owner's behalf.
17. Termination
17.1 By You. You may cancel your subscription at any time through your department settings or by contacting support@pump-forge.com. Cancellation takes effect at the end of the current billing period. No refunds will be issued for partial billing periods.
17.2 By Us. We may suspend or terminate your access immediately and without prior notice if: (a) you violate this Agreement; (b) you fail to pay fees when due; (c) you engage in conduct that harms the Platform, other users, or our reputation; or (d) we are required to do so by law.
17.3 Effect of Termination. Upon termination, your right to access the Platform ceases immediately. Sections 7, 9, 10, 12, 13, 14, 15, 19, 20, 21, 22, 23, 24, and 25 shall survive termination of this Agreement. Customer Data will be retained for 90 days post-termination as described in Section 11.
18. Availability and Uptime
We strive to maintain high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, updates, security patches, or circumstances beyond our control. We will make commercially reasonable efforts to provide advance notice of planned downtime via email to department administrators.
19. Dispute Resolution and Arbitration
19.1 Informal Resolution. Before initiating any formal dispute resolution proceeding, you agree to first contact us at legal@pump-forge.com and attempt to resolve the dispute informally for at least 30 days.
19.2 Binding Arbitration. If the dispute cannot be resolved informally, you and PumpForge LLC agree that any dispute, claim, or controversy arising out of or relating to this Agreement or the Platform shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator in the State of Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
19.3 Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or Confidential Information without first engaging in arbitration.
20. Class Action Waiver
21. Government and Public Entity Provisions
If you are a government entity, municipality, fire district, or other public body, you acknowledge that: (a) this Agreement is subject to applicable public procurement laws and regulations; (b) to the extent any provision of this Agreement conflicts with mandatory provisions of applicable law governing government contracts, such mandatory provisions shall control; and (c) the Platform and its documentation qualify as "commercial computer software" and "commercial computer software documentation" as defined in FAR 12.212 and DFARS 227.7202, and are provided with only those rights as are granted to all other end users under this Agreement.
22. Third-Party Services
The Platform integrates with third-party services including but not limited to Stripe (payment processing), Amazon Web Services (infrastructure), and email delivery services. Your use of these third-party services is subject to their respective terms of service and privacy policies. PumpForge LLC is not responsible for the availability, accuracy, or practices of any third-party service.
23. Force Majeure
PumpForge LLC shall not be liable for any failure or delay in performing its obligations under this Agreement due to causes beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, war, terrorism, riots, government actions, power failures, internet or telecommunications failures, cyberattacks, or failures of third-party service providers.
24. General Provisions
24.1 Governing Law. This Agreement is governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Florida.
24.2 Entire Agreement. This Agreement, together with the Privacy Policy and any order forms or subscription agreements, constitutes the entire agreement between you and PumpForge LLC regarding the Platform and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings, whether written or oral.
24.3 Severability. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
24.4 Waiver. The failure of PumpForge LLC to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of PumpForge LLC.
24.5 Assignment. You may not assign or transfer this Agreement or any rights or obligations hereunder without the prior written consent of PumpForge LLC. PumpForge LLC may assign this Agreement without restriction. Any attempted assignment in violation of this section shall be null and void.
24.6 Notices. All legal notices to PumpForge LLC must be sent to legal@pump-forge.com. Notices to you will be sent to the email address associated with your department administrator account.
24.7 Headings. Section headings are for convenience only and shall not affect the interpretation of this Agreement.
25. Modifications to Terms
We may update this Agreement from time to time. Material changes will be communicated via email to department administrators at least 30 days before they take effect, or through a prominent notice on the Platform. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the revised Agreement. If you do not agree to the revised terms, you must stop using the Platform and cancel your subscription.
